OFFICIAL RULES CAMPAIGN „GIFT VOUCHER”

IMPACT DEVELOPER & CONTRACTOR S.A., with headquarters in Bucharest municipality, Sector 1, Drumul Padurea Mogosoaia, No. 31-41, postal code 014043, registered at the Trade Register under no. J40/7228/2018, having fiscal code RO1553483 and account RO82BTRL05001202G09193XX opened at Banca Transilvania – Otopeni Branch, represented by Mr. Constantin Sebesanu, as General Director, and Mr. Sorin Apostol, as Administrator, currently referred to in this regulation as “the Organizer”,

He/She decided to organize a campaign starting from the date of 17.10.2022, until the date of 31.12.2023, through which a voucher is granted for the purchase of furniture, with the following customer benefits:

• 3,000 Euros for studio and 2-room apartments (VAT included)
• 4,000 euros for 3-room apartments (VAT included)

Upon signing a reservation agreement or a bilateral promise of sale-purchase for any type of residential unit mentioned among those offered, along with a parking space within the Greenfield Baneasa complex, by the date of 30.11.2022. In case of signing a reservation, the voucher will only be applied on the condition of signing a bilateral sales and purchase agreement for the reserved property, within a maximum of 45 calendar days from the date of signing the reservation.

The voucher applies to furnishing the home from one of IMPACT's collaborating furniture suppliers at the time of the home's handover.

The voucher's value will be paid by IMPACT DEVELOPER & CONTRACTOR SA directly to the furniture supplier selected by the client, after the final Sale-Purchase agreement for a residential unit in Greenfield Baneasa is signed and after the furniture order is placed with the supplier.

The total value of the vouchers cannot exceed 100,000 Euros (I owe you a thousand euros) (VAT included).

The total value of all vouchers awarded under the Campaign cannot exceed 100,000 Euros (I owe you a thousand euros(VAT included). If this amount is reached, registration for this Campaign ends.

The campaign follows the next regulation:

SECTION 1. ORGANIZER AND OFFICIAL RULES

The campaign is organized by:

IMPACT DEVELOPER & CONTRACTOR S.A., with headquarters in Bucharest municipality, Sector 1, Drumul Padurea Mogosoaia, No. 31-41, postal code 014043, registered at the Trade Register under no. J40/7228/2018, having fiscal code RO1553483 and account RO82BTRL05001202G09193XX opened at Banca Transilvania – Otopeni Branch, represented by Mr. Constantin Sebesanu, as General Director, and Mr. Sorin Apostol, as Administrator, currently referred to in this regulation as “the Organizer”,

Campaign participants are obligated to comply with the terms and conditions of the Official Campaign Regulations, as mentioned below (hereinafter referred to as the „Official Regulations”).

The participation/organizing regulation is available free of charge to any applicant, displayed on the website https://www.greenfieldresidence.ro/baneasa/blog/

 SECTION 2. PARTICIPANTS

Any individual over 18 years of age, or any legal entity that cumulatively meets the following requirements, can participate in this campaign:

• Participated in at least one event during the Sports Festival from September 16-18, 2022.
• Specify the number of participants and the event the sales consultant participated in.
• Conclude a pre-sale agreement or a bilateral sales agreement for any of the available residential units in Greenfield Băneasa and for the parking space allocated to each, regardless of the payment method (own funds or bank credit), by the date of 11.2022. In the event of signing a reservation, the voucher will only be applied on the condition that a bilateral sale and purchase agreement for the reserved property is signed within a maximum of 45 calendar days from the date of signing the reservation;
• Place a furniture order within a maximum of 60 days from the signing of the final sales contract.

 A participant is identified by their first and last name and the contract entered into, in the case of individuals, and by the company name, CUI, legal representative, and the contract entered into, in the case of legal entities.

Each participant can choose any type of housing unit, depending on availability at the time of signing the bilateral sale-purchase agreement.

SECTION 3. CAMPAIGN DURATION AND LOCATION

The campaign takes place between 17.10.2022 – 30.11.2023, in accordance with the provisions of these Official Rules.

The campaign will be communicated to the participants of the Sports Festival via a dedicated newsletter.  

 SECTION 4. CAMPAIGN DESCRIPTION AND VOUCHER VALUE

Impact Developer & Contractor offers participants of the Festival of Sports event, held from September 16-18, 2022, a voucher with the values mentioned on page 1 of these regulations. These vouchers will be paid directly by IMPACT DEVELOPER & CONTRACTOR SA to the furniture supplier chosen by the client, from the list of selected suppliers/partners.

Thus, the furniture purchase voucher has the following advantages for customers, when decorating and furnishing their property in Greenfield Baneasa from furniture suppliers, IMPACT partners, at the time of property handover:

• 3,000 Euros for studio and 2-room apartments (VAT included)
• 4,000 euros for 3-room apartments (VAT included)

The voucher's value is net of taxes. All tax obligations (payment and declarations) are borne by the organizer.

The voucher is identified by a code. The voucher can only be used if the following three conditions are cumulatively met:

• Possession of the physical voucher;
• Proof of participation in the Sports Festival from 09/16/2022 to 09/18/2022 (competition number and event participated in)
• signing a reservation agreement or a bilateral sales agreement for any type of residential unit available, along with a parking space within the Greenfield Baneasa complex, by November 30, 2022. In the case of signing a reservation agreement, the voucher will only apply on the condition of signing a bilateral sales agreement for the reserved property within a maximum of 45 calendar days from the date of signing the reservation.;
• Place a furniture order within a maximum of 60 days from the signing of the final sales contract.

The properties are only purchased together with at least one parking space.

The reservation agreement/promise to sell/or the final sale and purchase agreement concluded under this campaign cannot be assigned.

The gift voucher can be used when signing a reservation or a bilateral preliminary sales and purchase agreement for one of the available properties, subject to availability. For furniture orders, the voucher will be attached to both the bilateral preliminary sales and purchase agreement and the sales and purchase agreement.

The voucher can be used for 60 days from the signing of the Final Sale and Purchase Agreement. After this date, the voucher will expire.

The voucher is transferable and can be used once, for a single property.

Multiple vouchers cannot be combined for the purchase of a single property.

The voucher cannot be exchanged for cash. No change will be given when using the voucher.

The gift voucher, with the mentioned amount, cannot be combined with any other discount or promotional campaign simultaneously run by the Organizer.

Forgery and fraudulent use of the voucher are punishable by law.

SECTION 5. PERSONAL DATA PROTECTION

For the purpose of participating in the campaign Impact Developer & Contractor it will process the names, surnames of the prospective buyers identified by CNP, ID card series and number, address, marital status (if applicable), and email address.

The legal basis for processing this data is Article 6(1)(b) of the GDPR.

In the event that personal data processing by a processor becomes necessary, Impact Developer & Contractor will conclude a contract with this one in accordance with Article 28 of the GDPR.

In the event that the Organizer is obliged to calculate, withhold, and pay the tax due for the income obtained by the winners in accordance with Law no. 227/2015 on the Fiscal Code, it will also process personal data for this purpose.

All participants in the promotion are guaranteed rights in accordance with the provisions of the Regulation on the protection of personal data no. 2016/679, as follows:

- the right of access, based on which participants can request, free of charge, confirmation as to whether or not personal data concerning them are being processed. Participants can also request a copy of the data processed by the Organizer. Requests must contain relevant information to identify participants in the database.

the right to rectification, which participants can exercise by submitting a request to modify the information the Organizer already has about the Participants. Participants can submit such a request when they notice that their data is incomplete or inaccurate;

the right to restrict processing, which can be exercised when the accuracy of the data is contested, the processing is considered unlawful, or when objecting to the erasure of data. Following the exercise of this right, the Organizer may continue to store the data, and other processing operations will only be possible with the participants' consent, except in cases expressly provided by law;

the right to portability, which they can exercise only in cases where the processing is based on the participant's consent or contract, and only if the data is processed by automated means. If the conditions are met, they can submit a data portability request to the operator of their choice;

the right to object to the processing of data for marketing purposes. The Participant may exercise this right at any time, and the Organizer will ensure that their data will no longer be processed for this purpose. However, there is a possibility that a reasonable period of time (48 hours) may be required to register and resolve the request, during which you may still receive marketing information;

– the right to erasure, by which the Organizer is obliged to delete the personal data they process about the participant. This right is not absolute, being applicable only in certain situations expressly provided for by law. When an erasure request is made, Participants are asked to bear in mind that data erasure can be a complex process.

– If you are not satisfied with how your requests have been resolved, you can always contact the Supervisory Authority at www.dataprotection.ro.

Personal data collected within this Campaign will not be disclosed to third parties, except in cases where the Organizer is required to comply with obligations imposed by current legislation.

The organizers undertake to keep the personal data of the Participants confidential. Participants agree that their personal data may be used by the Organizers for future promotional activities, without any further obligations or payments.

SECTION 6. FINAL PROVISIONS

By participating in this campaign, participants declare that they agree to respect and comply with all provisions, terms, and conditions of these Regulations.

The organizers reserve the right to modify these regulations during the campaign period, without prior notice.

The organizers do not assume responsibility, including, but not limited to, accepting falsified or damaged vouchers;

The organizers reserve the right to check and monitor the progress of the Campaign. In case of suspected fraud, they may refuse the use of the voucher.;

The organizers reserve the right to permanently exclude any Participant in the Campaign who, through fraudulent behavior, disrupts the proper conduct of the Campaign.

The organizers do not assume any inconvenience caused by unannounced internet provider interruptions/malfunctions, incorrect email address submissions, non-acceptance of commercial communication terms, or internal access blockages due to network congestion during peak traffic periods.

Any misunderstandings that may arise between the Campaign Organizers and the Campaign Participants will be resolved amicably or, if this is not possible, disputes will be settled by the competent Romanian courts.
